dc.description.abstractΟ θεσμός των προγραμματικών συμβάσεων αποτελεί θεσμό αφενός συνεργασίας της τοπικής αυτοδιοίκησης με τη κεντρική διοίκηση και κοινωνικούς φορείς με στόχο την εφαρμογή των πολιτικών της, αφετέρου θεσμό που συμβάλλει στην ανάπτυξη σε τοπικό και περιφερειακό επίπεδο. Στόχος, συνεπώς, του θεσμού των προγραμματικών συμβάσεων είναι η καλύτερη δυνατή επίτευξη συνεργασίας μεταξύ της τοπικής αυτοδιοίκησης, του δημόσιου και κοινωνικού τομέα, με σκοπό την μελέτη και εκτέλεση έργων ή την παροχή υπηρεσιών, ώστε να επιτευχθεί η ανάπτυξη μιας περιοχής καθώς και την βελτίωση του βιοτικού επιπέδου των κάτοικων μέσα από την υλοποίηση αυτών. Αφετηρία των συμβαλλομένων μερών στις προγραμματικές συμβάσεις είναι η ισοδύναμη συμμετοχή τους για την επιδίωξη και την εξυπηρέτηση του κοινού, δημόσιου, σκοπό, με χαρακτήρα αναπτυξιακό σε τοπικό επίπεδο. Στις συμβασιακές πολιτικές της τοπικής αυτοδιοίκησης, ο θεσμός των προγραμματικών συμβάσεων, εισάγεται σχετικά πρόσφατα, σε σχέση με τις λοιπές μορφές συμβάσεων, οι οποίες εφαρμόζονται για την πραγματοποίηση των δραστηριοτήτων της. Η μορφή των συμβάσεων, το αντικείμενό τους και τα στοιχεία του περιεχομένου των προγραμματικών συμβάσεων, δημιούργησαν νομικά ζητήματα και τα ελληνικά δικαστήρια έχουν επιληφθεί τέτοιων υποθέσεων, τόσο ως προς τον δημοσιονομικό έλεγχο, όσο και ως προς τη διαδικασία σύναψης των συμβάσεων. Στην πράξη, πάντως, έχει γίνει ευρεία εφαρμογή του θεσμού των προγραμματικών συμβάσεων, τόσο για την εκτέλεση έργων, όσο και την παροχή υπηρεσιών. Στην εργασία αυτή θα απασχολήσουν ζητήματα σχετικά με τη μελέτη των προγραμματικών συμβάσεων, με τη χρήση συγκεκριμένων παραδειγμάτων, ώστε να αναδειχθεί ο αναπτυξιακός χαρακτήρας του θεσμού.el
dc.description.abstracttranslatedThe institution of programmatic contracts is on one hand an institution of cooperation of local government with the central administration and social bodies in order to implement its policies, on the other hand an institution that contributes to development at local and regional level. The aim, therefore, of the institution of programmatic contracts is to achieve the best possible cooperation between the local government, the public and the social sector, in order to study and execute projects or provide services, so as to achieve the development of a region as well as the improvement of the residents’ living standards through their implementation. The starting point of the contracting parties to the programming contracts is their equivalent participation in the pursuit and service of the public, a common purpose in regions with a developmental character at the local level. In the contractual policies of the local government, the institution of programmatic contracts, is introduced relatively recently, in relation to the other forms of contracts, which are applied for the realization of its activities. The form of the contracts, their subject matter and the content elements of the programmatic contracts have created legal issues and the Greek courts have dealt with such cases, both in terms of financial control and in terms of the procurement procedure. In practice, however, the institution of programmatic contracts has been widely applied, both for the execution of projects and for the provision of services. In this project, we will address issues related to the study of programming contracts, using specific examples, in order to highlight the developmental character of the institution.el
