dc.description.abstractΑντικείμενο της παρούσης διπλωματικής εργασίας είναι η συμμόρφωση της δημόσιας διοίκησης στην ελληνική νομολογία και ειδικότερα στις δικαστικές αποφάσεις που εκδίδονται αφενός από το Συμβούλιο της Επικρατείας και αφετέρου από τα Διοικητικά Δικαστήρια. Πρόκειται για ένα ζήτημα με θεωρητικά θεμέλια το οποίο, όμως, έχει σημαντικές προεκτάσεις και δυσχέρειες στην πράξη. Παρουσιάζεται το νομικό πλαίσιο στο οποίο εδράζεται η υποχρέωση αυτή για συμμόρφωση, το νομικό καθεστώς που την διέπει και οι μορφές εκδήλωσής της αλλά και παραβίασης της. Κυριότερος στόχος της παρούσης είναι να καταδείξει αφενός την διαχρονικότητα του φαινομένου της μη συμμόρφωσης ή της καθυστέρησης συμμόρφωσης της δημόσιας διοίκησης στις διοικητικές δικαστικές αποφάσεις και αφετέρου την δυνατότητα αντιμετώπισής του με καίριες παρεμβάσεις.el
dc.description.abstracttranslatedThe subject of this postgraduate thesis is the compliance of the public administration with greek case-law and in particular with the decisions of courts issued by the Council of State on the one hand and the Administrative Courts on the other. This is an issue with theoretical foundations which, however, has significant implications and difficulties in practice. The legal framework on which this obligation to comply is based, the legal status that rules it and the forms of its demonstration and violation are presented. The main objective of this thesis is to demonstrate on the one hand the timelessness of the phenomenon of non-compliance or delayed compliance of the public administration with administrative judicial decisions and on the other hand the possibility of addressing it with key interventions. The research question that is investigated in this postgraduate thesis with bibliographic research is whether, how and to what extent the public administration can comply with its obligation to comply with administrative court decisions. The methodology used to write this postgraduate thesis is the study of scientific books, the study of Greek case law and in particular court decisions of the Council of State as well as the Greek Administrative Courts, the use of bibliography, articles, legislation as well as official websites such as the website of the Ombudsman, the website of the Supreme Court of Greece and the website of the State Legal Service. The filibustering of the public administration to comply with administrative court decisions which have ruled in favor of the governed is a phenomenon that has been of concern for a long time. In the indicative cases cited in the last chapter of this postgraduate thesis, as well as in the vast majority of cases that were the subject of investigation by the Greek Ombudsman, especially in 2023, it was proven that the intervention of the Greek Ombudsman played a catalytic role, as, after it took place, the relevant court decisions were executed, making up for the deficit that exists in terms of the effectiveness of the judicial protection provided to the administrators. This proves that the causes of either non-compliance or delayed compliance of the public administration with administrative court decisions, which over the years remain identical, are not incurable. Taking into account, however, the current constitutional and legislative framework governing the obligation of the public administration to comply with administrative court decisions, as this has been explained in detail herein, it is understood that the phenomenon of violations of this obligation, the non-compliance of the public administration, is not the result of weakness or gaps in the legislation but the result of a non-result oriented public administration. Consequently, ways of preventing, addressing and treating the phenomenon should be sought in this direction and therefore at the level of the public administration and in the general framework of operation of the political system.el
