| dc.description.abstract | Η παρούσα διπλωματική εργασία εξετάζει τη σημασία του Κράτους Δικαίου ως θεμελιώδη αρχή της Ευρωπαϊκής Ένωσης και αναλύει τις προκλήσεις που αντιμετωπίζει το Μαυροβούνιο στην προσπάθειά του να εδραιώσει αυτή την αρχή, με γνώμονα την ένταξή του στην ΕΕ. Η διεύρυνση της ΕΕ προς τα Δυτικά Βαλκάνια αποτελεί στρατηγική της προτεραιότητα για την διασφάλιση της σταθερότητας στην περιοχή. Μέσα από τη μελέτη αυτή, φωτίζονται οι δυσκολίες που παρουσιάζονται στην ενταξιακή πορεία του Μαυροβουνίου και ο ρόλος της ΕΕ στην υποστήριξη της εδραίωσης του Κράτους Δικαίου στην χώρα. Το Κράτος Δικαίου ως κεντρική αξία που διέπει τα μέλη της ΕΕ, αποτελεί συγχρόνως το κυριότερο κριτήριο για την ένταξη νέων κρατών-μελών σε αυτή. Η ΕΕ έχει δημιουργήσει ισχυρούς μηχανισμούς εποπτείας για να διασφαλίσει ότι τόσο τα κράτη-μέλη, όσο και οι υποψήφιες χώρες τηρούν απαρέγκλιτα τις αρχές του Κράτους Δικαίου. Ωστόσο, το φιλόδοξο όραμα για την ένταξη του Μαυροβουνίου στην ΕΕ έρχεται αντιμέτωπο με σοβαρές προκλήσεις στον τομέα του Κράτους Δικαίου, όπως την διαφθορά, την πολιτική αστάθεια, και την απουσία δικαστικής ανεξαρτησίας. Η μελέτη εστιάζει στη δικαστική μεταρρύθμιση ως κρίσιμο στοιχείο για τη διασφάλιση του Κράτους Δικαίου στο Μαυροβούνιο και στα εργαλεία που προσφέρει η ΕΕ, ως αρωγός στην εξυγίανση του. Παρά τις σημαντικές προσπάθειες και την υποστήριξη από την ΕΕ, η πρόοδος στο Μαυροβούνιο παραμένει αργή, με την πολιτική αστάθεια και τις εσωτερικές διαιρέσεις να συνεχίζουν να αποτελούν σημαντικά εμπόδια στην εισχώρηση του Μαυροβουνίου στην Ένωση. | el |
| dc.description.abstracttranslated | This thesis examines the significance of the Rule of Law as a fundamental principle of the European Union and analyzes the challenges faced by Montenegro in its efforts to establish this principle, as a prerequisite on its accession to the EU. The expansion of the EU to the Western Balkans is a strategic priority for ensuring stability in the region. This study illustrates the difficulties in Montenegro's accession process, as well as the role of the EU in supporting the establishment of the Rule of Law in the country. The Rule of Law, as a main value -that characterizes EU member states- is simultaneously the most important criterion for the integration of new member states. EU has created strong supervision mechanisms to ensure that both member states and candidate countries comply with the principles of the Rule of Law. However, Montenegro's ambitious vision for EU accession faces serious challenges in the area of the Rule of Law, such as corruption, political instability, and inadequate judicial independence. The study focuses on judicial reform as a crucial element for ensuring the Rule of Law in Montenegro and the tools offered by the EU to support its rehabilitation. Despite significant efforts and EU support, progress in Montenegro remains slow, with political instability and internal divisions continue to pose significant obstacles to Montenegro’s integration into the Union. | el |
