| dc.description.abstract | H διαρκώς αυξανόμενη παγκοσμιοποίηση έχει φέρει μια καινούρια πραγματικότητα, η οποία ξεπερνά τα πλαίσια των κρατικών δικαίων και γεννά δυνάμεις ικανές να παράγουν δίκαιο, πέραν και εκτός των παραδοσιακών πηγών δικαίου. Ο πυρήνας της συζήτησής μας είναι το “διεθνικό” δίκαιο - transnational law - στον αθλητικό χώρο, η λεγόμενη lex sportiva. Στη διάδρασή της με τα παραδοσιακά εθνικά δίκαια και το διεθνές δίκαιο, μπορεί να συγκρούεται μαζί τους, αλλά επίσης και να συμβιώνει. Το ερευνητικό μας ζήτημα είναι: πώς αντιμετωπίζονται οι αθλητικές διαφορές κατά τη επίλυσή τους από ένα δικαιοδοτικό όργανο; Ποιο είναι το αρμόδιο δικαστήριο και το δίκαιο που εφαρμόζεται; Τα ερωτήματα μας είναι: από πού πηγάζουν οι κανόνες δικαίου στον αθλητικό χώρο; Υπάρχει αθλητικό δίκαιο ως ξεχωριστός κλάδος δικαίου; Υπάρχει αυτόνομη αθλητική έννομη τάξη; Πώς αλληλεπιδρά η lex sportiva με τα παραδοσιακά νομικά συστήματα; Εφαρμόζεται από τα εθνικά και διεθνή δικαστήρια; Μπορεί να θεωρηθεί το Διαιτητικό Δικαστήριο για τον Αθλητισμό (CAS) ένα αυθεντικό ανεξάρτητο και αμερόληπτο δικαστήριο; Πώς αντιμετωπίζεται το CAS και οι αποφάσεις του από τα εθνικά και διεθνή δικαστήρια; Η μελέτη μας έχει αφετηρία την υπόθεση Pechstein, λόγω των πολλαπλών διεθνών, εθνικών και διεθνικών συστημάτων, νόμων και δικαστηρίων, που ενεπλάκησαν στην επίλυση της αθλητικής αυτής διαφοράς, η οποία αποτελεί μια μοναδική περίπτωση ανάδειξης του νομικού πλουραλισμού, που κυριαρχεί ιδιαίτερα στον αθλητικό χώρο. Η μελέτη μας ξεκινάει λοιπόν από βασικά ζητήματα, (έννοια αθλητικού δικαίου, έννοια διεθνικού δίκαιου, έννοια lex sportiva), θα παρουσιάσουμε την οργάνωση και τη λειτουργία του CAS και θα παραθέσουμε τη διαδικασία ακύρωσης των αποφάσεών του ενώπιον του Ανώτατου Ομοσπονδιακού Δικαστηρίου της Ελβετίας. Μετά την ανάλυση όλων αυτών, θα παρουσιάσουμε όλο το διαδικαστικό ιστορικό της υπόθεσης Pechstein σε όλες τις βαθμίδες, την εξέλιξη της υπόθεσης αυτής ενώπιον του Ευρωπαϊκού Δικαστηρίου για τα Ανθρώπινα Δικαιώματα και θα εξετάσουμε την σχέση του Ευρωπαϊκού δικαίου με τον αθλητικό χώρο. | el |
| dc.description.abstracttranslated | The ever-increasing globalization has brought a new reality, which goes beyond the framework of state laws and gives birth to forces capable of producing law, beyond and outside the traditional sources of law. The core of our discussion is the "transnational" law in the sports field, the so-called lex sportiva. In its interaction with traditional national laws and international law, it can conflict with them, but also coexist. Our research question is: how are sports disputes treated when they are resolved by a judicial body? Which court is the competent one and which law is the applicable law? Our questions are: where do the rules of law in sports come from? Does sports law exist as a separate branch of law? Is there an autonomous sports legal order? How does lex sportiva interact with traditional legal systems? Is it enforced by national and international courts? Can the Court of Arbitration for Sport (CAS) be considered a genuine independent and impartial tribunal? How are CAS and its decisions treated by national and international courts? Our study starts with the Pechstein case, due to the multiple international, national and transnational systems, laws and courts involved in the resolution of this sports dispute, which is a unique case of the emergence of the legal pluralism, that dominates the sports field. Our study therefore starts from basic issues, (concept of sports law, concept of transnational law, concept of lex sportiva), we will present the organization and operation of CAS and list the procedure for the annulment of its decisions before the Supreme Federal Court of Switzerland. After analyzing all this, we will present the entire procedural history of the Pechstein case at all court levels, the development of this case before the European Court of Human Rights and we will examine the relationship of European law with the sports field. | el |
