dc.description.abstractΗ παρούσα εργασία έχει ως αντικείμενό της ένα μείζον πρόβλημα που αποκτά ολοένα και μεγαλύτερες διαστάσεις τον αθλητισμό, ήτοι εκείνο της χειραγώγησης των αθλητικών αγώνων. Μέσω της εξέτασης της νομικής φύσης του αθλητισμού και της σχέσεως της έννομης τάξης που αυτός συγκροτεί με την αντίστοιχη κρατική έννομη τάξη θα αναζητηθούν οι εθνικές και υπερεθνικές κατευθύνσεις που ακολουθήθηκαν στην προσπάθεια αντιμετώπισης του σημαντικού αυτού προβλήματος. Επιπλέον, για την πληρέστερη εξέταση του ζητήματος της χειραγώγησης των αθλητικών αγώνων κρίθηκε σκόπιμο να εξεταστούν αποφάσεις του Διαιτητικού Δικαστηρίου του Αθλητισμού, προκειμένου να διερευνηθεί ο τρόπος αντιμετώπισης και αξιολόγησης των ζητημάτων που ανακύπτουν στην πράξη, καθώς και ο τρόπος που αυτά αντιμετωπίζονται μέσα από το αρμόδιο Διαιτητικό Δικαστήριο. Πράγματι, η παρουσίαση και ανάλυση μίας σειράς αποφάσεων δύναται να προσφέρει ένα πληρέστερο πεδίο εξέτασης του πολυεπίπεδου αυτού ζητήματος της χειραγώγησης των αθλητικών αγώνων, ώστε να αξιολογηθεί το υφιστάμενο νομοθετικό πλαίσιο, και εν συνεχεία να διατυπωθούν προτάσεις βελτίωσής του.el
dc.description.abstracttranslatedThe present work has as its object a major problem that is gaining ever greater dimensions in sports, namely that of the manipulation of sports competitions. Through the examination of the legal nature of sport and the relationship of the legal order that it constitutes with the corresponding state legal order, the national and supranational directions that were followed in the attempt to deal with this important problem will be sought. In addition, for a more complete examination of the issue of the manipulation of sports competitions, it was considered appropriate to examine decisions of the Court of Arbitration for Sport, in order to investigate the way of dealing with and evaluating the issues that arise in practice, as well as the way in which they are dealt with through the competent Arbitral Tribunal. In fact, the presentation and analysis of a series of decisions can offer a more complete field of examination of this multi-level issue of the manipulation of sports matches, in order to evaluate the existing legislative framework, and subsequently formulate proposals for its improvement.el
