| dc.description.abstract | Σύμφωνα με το άρθρο 102 παρ. 4 του Συντάγματος το κράτος ασκεί στους ΟΤΑ εποπτεία που συνίσταται αποκλειστικά σε έλεγχο νομιμότητας. Με το Ν.3852/2010 (Πρόγραμμα Καλλικράτης) συστήνεται η Αυτοτελής Υπηρεσία Εποπτείας ΟΤΑ, η οποία εντάσσεται στην οργανωτική δομή της οικείας Αποκεντρωμένης Διοίκησης με αποκλειστική αρμοδιότητα τον έλεγχο νομιμότητας των πράξεων στους ΟΤΑ και τον πειθαρχικό έλεγχο των αιρετών. Η παρούσα εργασία πραγματεύεται τον έλεγχο νομιμότητας επί των οικονομικών πράξεων των Δήμων από την Αποκεντρωμένη Διοίκηση, η αναγκαιότητα του οποίου αποκτά βαρύνουσα σημασία στη σημερινή οικονομική κρίση και ο σκοπός της είναι να απαριθμήσει αυτές που πρέπει υποχρεωτικά να αποστέλλονται για έλεγχο, να παρουσιάσει τις σημαντικότερες και να αναλύσει τον ασκούμενο επί αυτών έλεγχο νομιμότητας. | dc.description.abstracttranslated | According to article 102 (4) of the Constitution the State exercises supervision of the Local Government Agencies which consists exclusively in the review of the legality. Law No. 3852/2010 (Kallikratis Program) establishes the Independent Supervisory Authority of the Local Government Agencies, which is part of the organizational structure of the Decentralized Administration concerned and has the exclusive competence of the legality control of the operations of the Local Government Agencies and disciplinary control of the elected. The present thesis treats the subject of the legality review of the financial operations of the municipality by the Decentralized Administration, the necessity of which is all the more significant in today’s economic crisis and its’ aim is to enumerate which of the above operations must be sent to review, to present the most important and analyze the exercised legality review. Finally, the conclusions and suggestions are set out at the end of this thesis. | el |
